Once the Contractor has taken possession of the site there is no general right at common law for the Employer or its associated persons to come onto the site, monitor works or view what is going on. The Contractor has the power to exclude people from site that do not have the right to be there.
It is, therefore, important to set up the rights of access in the Contract to allow different groups to do their job. The Employer’s Agent, for example, will struggle to do its job unless it can attend site. In addition, there are a number of other representatives, such as the site manager, who should be considered.
This module will also briefly cover what to do if an antiquity or unexploded bomb is found on site.
