The FIDIC suite of contracts is most commonly used for process plant, energy or other complicated projects which will require some level of testing (and possibly a commissioning period) before the Employer will accept the Works as being complete.
Clause 9 sets out the requirements for the testing process, backed up by elements of the Specification which go into specifics about the nature of the tests and requirements to pass them.
After completing this course, you should be able to:
- Explain the process of testing, including the required Notices
- Understand what happens if tests are failed, along with the consequences
- Set out what happens if the tests are delayed by the Contractor and know where to look for the consequences of any Employer delays
- Explain what is meant by taking over and how the Certificate of Taking-Over is issued
