Having finished with the Employer it is now time to move on to its agent, the Engineer. This module takes you through the Engineer’s authority and duties under the Red Book. It will also take a look at the basics of the process for determining Claims and matters which are for the Engineer to determine.
It is important to remember that the Engineer while maintaining an impartial stance in most matters, is appointed and paid by the Employer. This duality of responsibilities can lead to some difficult positions for the Engineer, particularly when valuing works or determining Claims. However, its obligation to be fair between the Parties is enshrined in case law and can lead to more difficulties if not maintained.
