The aim of this course is to describe the process of adjudication and also the more traditional mechanisms to resolve disputes using arbitration and litigation, considering in particular the relative merits of the latter two as means of achieving a final solution to a construction dispute.

Learning Outcomes

After studying this course, you should be able to:-

• Outline into how disputes arising between the parties to a contract may be settled by an action in court through litigation, and as to which court is appropriate, this will depend upon a number of factors, including the size of the dispute, its nature and, in some cases, its location
• Outline the litigation procedure, and provide an example of useful remedies in construction cases
