Throughout the courses in the programme, you will have seen numerous references to Claims, generally being pursuant to Sub-Clause 20.2.  These are most commonly used where there is extra time or money to be determined in relation to an event or act, possibly after the agreement and determination process has been used.

This course now looks at the details of how Claims work, the types of claims and what the process for deciding them is.

Clause 20 was heavily updated in the 2017 version of the Red Book and has not always found favour with users.  The process it adopts is very convoluted, with many twists and turns that are not obvious to people going through the process.  It is not uncommon to see this Clause heavily amended or reverted back to the earlier 1999 version.
