Defects are a common area of issues and disputes in many contracts. The JCT2024 contains extensive provisions relating to how defects are to be dealt with and powers for the Employer when trying to review non-conformances, defects and other matters.
It is also important to understand how non-conformances and defects are dealt with during the works, as opposed to after practical completion as the two are handled differently. During the Works, the Contractor will have control of the site. After practical completion the Contractor will have left the site and it may be occupied by the Employer or others. This means that access may be required or people worked around.
