Having considered Claims in course 17, we now move to Disputes. This is the follow-on stage from Claims, when the Parties are still not happy with the Engineer’s determination, or where the Engineer has not complied with the Sub-Clause 3.7 process.
The Red Book has a number of routes to try and avoid Disputes arising, and also provides a mechanism for speedy resolution in a cost-effective manner. However, this requires the Parties to keep the DAAB apprised of happenings on the Project, so that time and money are not wasted in having to bring them up to speed when a Dispute does arise.
In this course, we refer to the DAAB Agreement. This is the agreement between the DAAB and the Parties, which will be covered in the final course of this programme.
