An Overview of NEC4 ECS X Clauses (Part 2)

This course continues where the last left off and finishes the journey through the X clauses.  In this course, we will look at clauses including:

• Termination at will
• Partnering provisions
• Subcontractor design
• Advance payments and performance bonds
• Retention; and
• Limits of Liability

Once you have completed this course, you will have finished the programme and should have a good working knowledge of the NEC4 Engineering and Construction Subcontract.

After completing this course, you should:

1. Understand how the optional multiparty collaboration clause operates (effectively partnering)
2. Know when advance payments must be made and repaid
3. Be able to discuss the optional Subcontractor design clause and its requirements
4. Know what options are available to limit a Subcontractor’s liability
5. Understand when and how Key Performance indicators may be used and the incentive payments that go with them
