In Module 3, we will be looking at some of the Key People named in the JCT Design and Build Form, along with their roles and why they are there.
It is important to understand who these groups are as they appear throughout the Contract in a number of areas. Some of them will have roles to play in the Works, others will expect rights to be granted to them, and still others will create potential liabilities for the Parties.
Where the Parties have to identify who is taking on different roles, this process should be completed carefully and with as much detail as is necessary to clearly identify the person or group undertaking the role. Any confusion later on may cause significant issues with operating the Contract.
