Clause 8 of the Red Book covers all matters to do with time, delay and suspension. It is more detailed than most other standard form contracts, not least as the Programme plays an important role in both controlling the Works and assessing any delays. If this is not kept up to date, claims for EOTs will become significantly more difficult. This is one of the most common reasons for disputes arising.
For this reason, the Employer, the Engineer and the Contractor should all ensure that they have sufficient planners available to maintain and review the Programme throughout the Works
After completing this course, you should be able to:
- Understand the basic obligation on the Contractor relating to completing the Works and progress
- Understand what the initial programme is and how and when it is updated
- Know the basic reasons why an EOT may be granted
- Be able to explain how suspensions may occur and the consequence
