Insolvency and Employer Termination under JCT SBC 2024

The JCT 2024 contains a number of rights for the Employer to terminate the Contractor’s Employment.  These are set out in clauses 8.4 – 8.6.  


It is important to understand that there is a difference between terminating the Contract and terminating the Contractor’s employment.  The latter, which is what the JCT2024 provides for, merely removes the obligations on the Contractor to complete the Works and design for the Contractor’s Designed Portion, while leaving the remainder of the Contract in place.


In this module we will look at the reasons why the Employer may terminate the Contractor’s employment, and consider the meaning of Insolvent in the JCT2024.
